IDDIAS is a trademark that has been registered in different jurisdictions and is protected accordingly including, but not only, the United Kingdom and in the United States.
These Terms of Use (referred to as "Terms") govern your usage of our IDDIAS app, except when we explicitly state that separate terms (and not these) apply and provide information about the operation of the app (the "Service"), outlined below. By creating an account or using our IDDIAS app, you fully agree to these terms.
Our Services encompass all aspects of our IDDIAS app and the software and systems that power these applications.
If you do not wish to read or accept these Terms, please refrain from using our Services. However, if you choose to use our Services, please understand that you are fully consenting to be bound by these Terms and the applicable Laws and regulations.
Welcome to IDDIAS! These Terms of Service ("Terms") govern your use of our mobile application ("App"), wherein users can search by face characteristics. By accessing or using our App, you agree to comply with and be bound by these Terms.
By using our App, you affirm that you are at least 18 years old and capable of forming a binding contract. If you do not agree with any part of the Terms, do not use our App.
You agree to provide accurate and complete information when creating an account. Misuse of the App for illegal activities is strictly prohibited.
Our Privacy Policy describes how we handle your personal data.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
We own all intellectual property rights to the App and its content. You may not copy, reproduce, or distribute any part of the App without our permission.
We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the date at the top of this document and sending a notice through the App.
We may terminate or suspend access to our App immediately, without prior notice or liability, for any reason, including if you breach the Terms.
The App is provided on an "as is" basis, without warranties of any kind.
These Terms are governed by and construed in accordance with the laws of Portugal, unless IDDIAS decides to replace for another jurisdiction.
We aim to make our Service as open and inclusive as possible while ensuring it is safe, secure, and compliant with the applicable laws and regulations and best practices. Therefore, we request that you comply with a few restrictions to be part of our community of users:
In these Terms, "you" and "your" will refer to you, and, for accounts created exceptionally on behalf of another person, if and when the person with the legal authority to create and operate the account.
You are not allowed and may not impersonate others or provide inaccurate information. While you are required to disclose your full identity on our app, you must provide accurate and up-to-date information, including registration details. Creating accounts as an exception for others without express permission is not allowed.

Our IDDIAS Privacy Policy outlines the data you share with us, when it is shared, and how we handle it when you start to use our Services. By using our Services, you acknowledge and consent to our collection, use, storage, processing, sharing, and transfer of this data to countries where we operate our Services and to partners who assist us in providing our Services.
Once you have uploaded your pictures in case you suspend the Services the Data will still be stored in the IDDIAS App unless you formally request that by cancelling or suspending our Services you want to remove your pictures.
You grant us permissions necessary to provide the Service:
We do not claim ownership of your content, but you grant us a license to use it for any purpose and for an unlimited time and territory. We respect your rights to the content you post on our Service, and you are free to share your content as you see fit. However, to provide the Service, we require certain legal permissions (referred to as a "license") from you. When you share content on our Service that is protected by intellectual property rights (such as photos or videos), you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works from your content.
You grant us permission to use your username, profile picture and pictures uploaded or generated in the IDDIAS App, and information about your interactions and relationships with accounts, ads, and sponsored content, if any. If applicable, this permission allows us to display your username, profile picture, and information about your actions or relationships in connection with accounts, ads, offers, and other sponsored content that you follow or engage with, without any compensation to you.
You agree that we can download and install updates to the Service on your device.
While we are not obligated to monitor the content, people share through our Services, we strive to maintain a platform where people can feel safe. Content which violates another person's rights or does not comply with any applicable laws, rules, regulations, best practices or these Terms (hereinafter, "Offensive Content"), is strictly prohibited. If you come across Offensive Content, you can report it to us. If you believe your Content has been copied in a way that infringes your intellectual property rights, you can also report this to us.
We retain the right to remove any content or information you share on the Service if we believe it violates these Terms or our policies, or if we are permitted or required to do so by law. We may also refuse to provide or stop providing all or part of the Service to you immediately if it is necessary to protect our community or services, if you create risk or legal exposure for us, if you violate these Terms or our policies, if you repeatedly infringe other people's intellectual property rights, or if we are permitted or required to do so by law.
We can also terminate or modify the Service, remove or block content or information shared on our Service, or cease providing all or part of the Service if we determine that doing so is reasonably necessary to avoid or mitigate adverse legal or regulatory impacts on us.
If you delete your account or if we disable or suspend your account, these Terms shall terminate as an agreement between you and us.
Our Trademark and Services are protected by copyright, trademark, trade secret, and other laws worldwide. While you are using our Services, we grant you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the software provided to you as part of our Services. This license is solely for enabling you to use and enjoy our Services in accordance with these Terms and applicable laws and regulations. The license ends when you suspend or stop using our Services.
Our Service is provided "as is," and we cannot guarantee it will be safe, secure, or perfect at all times. To the extent permitted by law, we also disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not control the actions, conduct, or content of people and others, whether online or offline, and we are not responsible for their (or your) actions or conduct or for content, including unlawful or objectionable content. We are also not responsible for services and features offered by other people or companies, even if you access them through our Service.
By using our Services since the first time, you agree that we, our affiliates, our related companies, as well as our officers, directors, employees, agents, representatives, partners, and licensors have limited liability to the maximum extent permissible in your country of residence, as long as your country of residence laws are enforceable to us.
To the extent that these Terms permit you or us to initiate legal action in court, both you and us consent to the exclusive jurisdiction of the Portuguese courts and the Portuguese law.

IDDIAS may make changes to our Service and policies, necessitating changes to these Terms to accurately reflect our Service and policies. If you continue to use the Service after such changes, you will be bound by the updated Terms. If you do not agree with these or any updated Terms, you have the option to suspend or delete your account bearing in mind that your face picture will remain in the database unless you specifically request to be removed.
